By accessing or using Guestbook ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We may modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Service Description

Guestbook is a software-as-a-service platform that enables property hosts to create, publish, and share digital guidebooks with guests. The Service includes:

• Creation and editing of digital guidebooks
• Publishing and sharing guidebooks via links and QR codes
• Property management and organization tools
• Guest messaging and communication features
• Analytics and usage insights

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Responsibilities

• You must be at least 18 years old (or the age of majority in your jurisdiction)
• You are responsible for all content you create, upload, or share through the Service
• You must notify us immediately of any unauthorized use of your account
• You may not share your account credentials with others

4. Acceptable Use Policy

5. Intellectual Property

5.1 Your Content

You retain ownership of all content you create, upload, or share through the Service ("Your Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute Your Content solely for the purpose of providing and improving the Service.

5.2 Our Service

The Service, including its software, design, features, and documentation, is owned by Guestbook and protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from the Service without our express written permission.

6. Payment Terms

6.1 Subscriptions

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, as selected during signup. All payments are processed securely through Stripe.

6.2 Pricing and Changes

We reserve the right to modify subscription pricing with 30 days' notice. Price changes will apply to your next billing cycle after the notice period. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6.3 Billing and Refunds

No Refunds Policy: All subscription fees are non-refundable. We do not offer refunds for any payments made for the Service, except as required by applicable law.

This policy is in place because our Service is free by default, allowing you to fully evaluate and use the platform before making any payment commitment. Payment is only required when you choose to publish your guidebooks or access premium features. This provides you with ample opportunity to:

• Try all features of the Service without any payment obligation
• Create and test guidebooks before publishing
• Evaluate whether the Service meets your needs
• Cancel your subscription at any time (though refunds are not provided)

By subscribing to a paid plan, you acknowledge that you have had the opportunity to evaluate the Service and that payment is made only when you are ready to publish or use premium features.

• If payment fails, we may suspend or terminate your access to paid features
• You are responsible for all applicable taxes, duties, or fees related to your use of the Service

6.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period you have already paid for.

7. Service Availability

We strive to provide reliable service, but we do not guarantee that the Service will be available 100% of the time. The Service may be unavailable due to:

• Scheduled maintenance or updates
• Unforeseen technical issues
• Issues with third-party services (hosting, infrastructure)
• Force majeure events beyond our control

We will make reasonable efforts to notify you of planned downtime and resolve issues promptly.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
• WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Guestbook and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any rights of another party.

10. Termination

10.1 Termination by You

You may stop using the Service and delete your account at any time through your account settings. Upon account deletion, we will delete or anonymize your personal data in accordance with our Privacy Policy.

10.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if you:

• Violate these Terms or our Acceptable Use Policy
• Fail to pay subscription fees when due
• Engage in fraudulent, illegal, or harmful activity
• Otherwise create risk or legal exposure for us

11. Data and Content Deletion

Upon termination of your account, we will delete Your Content within a reasonable timeframe, subject to legal retention requirements. You are responsible for exporting or backing up any content you wish to retain before closing your account. We are not responsible for any loss of content due to account termination.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. We may also notify you via email or through the Service for significant changes. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

If you are located in the European Union, you may also have the right to file a complaint with your local data protection authority.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Guestbook regarding the Service and supersede all prior agreements and understandings.
